General Photography Contract, Terms and Conditions

There are more specific T&C’s for more specialised types of photography please see below for relevant areas.
It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both Andrew Vincent Photography Ltd and the Client, in writing.

Booking Fee
The acceptance of the booking outlined on the booking form once completed is based on agreement by the client of the terms and conditions stated herein. Making a booking signifies your agreement to the terms and conditions below.

Payment
Payment for all items ordered must be made at the time of ordering. Prices for prints and framed prints are available on request.

Creative Licence
Andrew Vincent Photography Ltd shall be granted creative and artistic licence in relation to the choice of locations and poses used. Andrew Vincent Photography Ltd judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. Andrew Vincent Photography Ltd will do their best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement. Images taken may be used by Andrew Vincent Photography Ltd for marketing purposes.

Colour Photography
Colour photography is undertaken within the technical limitations of the process and certain colours may not necessarily be facsimile over the whole range of colours within a subject. Prints made at different times may be variable in colour balance. Please note that some fabrics and patterns react differently in some lighting conditions and can cause the colour of the clothes to change, giving incorrect colour beyond the photographer’s control – it is advisable therefore not to choose this kind of fabric – please discuss with the photographer if you are in any doubt, as they cannot be held responsible for the natural colour deviation which may occur.

Copyright
The 1998 Copyright, Designs, and Patents Act assigns copyright to Andrew Vincent Photography Ltd. You may not copy the photographs taken under this contact, or allow copies to be made photographically, electronically, or by any other means. This is a standard condition for most professional photographers. Unless authorized in writing from Andrew Vincent Photography Ltd. Also Unless otherwise stated in the order, the Andrew Vincent Photography retains copyright in all their original material. Original Material includes video recordings, graphics, soundtracks, printed material and any other design or artwork commissioned by the client/customer in relation to the order. The client/customer must ensure that permission is sought for the inclusion of any copyright material they supply to the Andrew Vincent Photography to enable them to deliver the product(s) or service(s). The client/customer must also ensure that permission is sought for the inclusion of any performers or performances, trademarks and locations. The Andrew Vincent Photography retains the right to use this material in its original and edited form as they see fit, unless otherwise agreed in the order. The client\customer agrees to indemnify the Andrew Vincent Photography in the event of any breach of copyright claims being brought against the Andrew Vincent Photography in respect of material supplied by the client/customer.

Force Majeure
In the unlikely event of total photographic failure, injury or sickness beyond Andrew Vincent Photography Ltd's
control, their liability shall be limited to a rearrangement of shoot date.

Cancellation
If Andrew Vincent Photography Ltd has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a reappoint a date. If the Client cancels the appointment within 48 hours prior to the reserved slot will forfeit the retainer/booking fee.

Postponement
Should the cancelled appointment turn out to be a postponement, then, subject to Andrew Vincent
Photography availability, the retainer/booking fee may be applied to the new appointment.

Postponement Due to Adverse Weather
If the appointment has to be cancelled by Andrew Vincent Photography Ltd due to adverse weather conditions a new, mutually agreed appointment will be made.

Complaints Procedure
Please address any complaints to Andrew Vincent Photography Ltd by email or telephone as per our contact details. We will endeavour to respond to any complaint within 2 working days of receipt..

Privacy
Andrew Vincent Photography Ltd will store your name and address details on a private internal database. These details will not be made available to third parties. Should you wish to have your details removed from our database, please advise us in writing.
